Intellectual Property Investigations in Vietnam
Intellectual property investigations in Vietnam can be difficult for businesses who have little experience. Likewise, this is especially difficult for international companies. For example, an international company may not have law enforcement relations. They may not have an adequate understanding of civil or criminal processes.
What is intellectual property?
Intellectual property (IP) refers to the creation of the mind and not necessarily a physical object. IP covers a vast range of works such as artwork, inventions, computer programs to trademarks etc.
Why is IP important?
Many jobs require people to spend countless hours developing something from an idea. This is true for any physical or conceptual product. Conceptual ideas in the digital world have value too. Even though this concept might not hold any physical value it doesn’t mean it isn’t valuable at all.
A logo can be a part of a brand. A brand gives products & services more value. This value can make or break a company. Ignoring IP can have significant ramifications. For example, a company has a popular product. Another company takes their logo and also puts it on their product. They make millions of dollars from that logo being on their product.
What about patents?
Patents were one of the first to be recognized as across modern legal systems. Today patents are intertwined into almost every man-made product in existence. By patenting an invention, the patent owner gets exclusive rights over it. This means the inventor can stop anyone from using, making or selling the invention with out explicit permission. For example, someone designs a longer lasting battery. Another person comes along, designs the exact same battery and changes the name.
Where & how do I get protection?
Inventors must decide which territory they want patent protection whether its national, regional, or international protection. Depending on the goals of the inventor it can result in significant fees to get applications approved. To avoid costs of approval with each country, many countries have come together and forged an agreement that allows for regional approval.
The World Intellectual Property Organization (WIPO) that allows applicants to request protection under the Patent Cooperation Treaty which grants protection with every member country participating in the treaty. They are the worldwide authority for this topic.
